Terms of Service

These Terms govern your use of asmrsleep.app ("Platform"), operated by ASMRsleep ("we", "us", "our"). By accessing or using the Platform, booking a session, or applying as an artist, you agree to these Terms. If you disagree, do not use the Platform.

1. Services Overview

We provide a marketplace connecting customers seeking personalized live ASMR sessions (via Zoom) with approved independent ASMR artists. We facilitate bookings, payments (25% commission), and Zoom meeting creation, but are not a party to the artist-customer agreement. Sessions are private and non-recorded by default.

2. Eligibility

You must be 18 or older and legally capable of entering into a binding agreement. Artists must meet platform requirements (Google sign-in, ≥200 YouTube subscribers, manual approval). We may refuse or suspend accounts at our discretion.

3. User Accounts & Conduct

• Customers: Guest checkout is allowed; provide accurate information.
• Artists: Maintain an accurate profile and availability; no misleading claims.
• Prohibited for all users: Harassment, explicit or illegal content, spam, fraud, and any violation of Zoom's Acceptable Use Guidelines. The platform is for relaxation and sleep ASMR only — adult or sexual services are strictly prohibited.

You are responsible for your conduct and session content. Report violations to support@asmrsleep.app.

4. Bookings, Payments & Cancellations

• Bookings are paid upfront via PayFast or PayPal.
• Artists set their own prices (minimum $15 for a 20-minute session); we retain a 25% platform commission.
• Artists receive 75% of the session fee net (processing and payout fees are covered from our share).
• Cancellation policy: Full refund if cancelled 48 hours or more before the session; 50% refund if cancelled 24–48 hours before; no refund if cancelled less than 24 hours before. Artist cancellations result in a full customer refund.
• No-shows are treated as a late cancellation.
• Disputes: Contact support; we mediate fairly but are not liable for session quality.

5. Zoom & Technical

We use a Zoom Pro central account; approved artists are added as licensed users. You must comply with Zoom's Terms of Service and Acceptable Use Policy. We are not liable for Zoom outages or technical issues.

6. Intellectual Property

Platform content (logos, design, software) is owned by us. User content (bios, sample links) remains yours; you grant us a non-exclusive license to display and promote it on the Platform.

7. Disclaimers & Limitation of Liability

Services are provided "as is". We do not guarantee sleep outcomes, artist performance, or uninterrupted platform access. To the extent permitted by law (including the Consumer Protection Act 68 of 2008), we exclude liability for indirect or consequential damages. Our maximum liability to you is limited to the session fee paid.

8. Indemnity

You agree to indemnify and hold us harmless against any claims, losses, or damages arising from your use or misuse of the Platform, your session content, or your breach of these Terms.

9. Termination

We may suspend or terminate accounts for violations of these Terms. Artists and customers may request account deletion, subject to any pending bookings or outstanding payouts.

10. Governing Law

South African law applies to these Terms. Any disputes will be resolved in the courts of Cape Town, Western Cape.

11. Changes

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
